Background check
Many states have passed laws or are considering measures dealing with the
"morning after" pill, also known as Plan B, that prevents pregnancy. The debate
has attracted many of the same advocates in the fight over abortion. The
legislation runs the gamut: allowing pharmacists to refuse to dispense such
drugs on moral grounds; requiring pharmacies to fill any legal prescription; and
allowing pharmacists to sell it over the counter.
IN OREGON
SALEM -- A bill that would empower pharmacists to dispense emergency
contraception directly to women without a doctor's prescription is expected to
come up for a vote sometime next week in an Oregon legislative committee.
Senate Bill 849 was introduced at the request of the attorney general's Sexual
Assault Task Force. The bill would require pharmacists who want to dispense
emergency contraception to consult with doctors or nurse practitioners.
"This will greatly benefit rape and incest survivors, and that's why we
requested it," Phyllis Barkhurst, the task force's executive director, said
Thursday.
National studies show that about 40 percent of women who are victims of rape or
incest do not seek treatment from a physician or rape crisis center. The bill
would allow them to go to a pharmacist instead and give them peace of mind
knowing they won't become pregnant as a result of the attack, Barkhurst said.
SB849 would not require a woman to say she is a victim of rape or incest before
she could buy emergency contraception from a pharmacist.
Abortion opponents have opposed similar legislation in other states, but
Barkhurst said no one raised objections during a Senate Rules Committee hearing
on SB849 earlier this month.
Gayle Atteberry, executive director of Oregon Right to Life, declined to comment
on the bill.
The bill's sponsor, Sen. Richard Devlin, D-Tualatin, said he has support to move
SB849 through the committee and out of the Senate. The House will be tougher,
though Devlin said he thinks there will be support once people understand the
