Employer's Responsibility

Employers
may be held liable for criminal acts committed by an employee, and may also be responsible
for lost wages and damages incurred as a result of discharging an employee. Check with
past employers and try to speak with someone not listed on the application who knows or
knew the applicant.
Twenty-eight states in the nation have negligent hiring doctrines. You want
to be very concerned about the background of an individual you're letting
into your home. There was a case in this county several years ago that
concerned a pest control company that was hired by several large
condominiums to come in and fumigate the condos. Most of the residents were
not home during the day. They would leave the key under the doormat or
whatever. The guy went in to spray. He saw pictures of a young woman - a
single woman and very lovely. He made a copy of her key, came back at
midnight, and raped her.
No one had checked
out the man's background. He had a criminal rap sheet as long as your arm. But the pest
control company that hired him had never checked him out. The condo association that hired
the pest control company never required them to check out their employees. So this
poor woman has to suffer the rest of her life for what she went through.
